Responsible Advertising: Understanding the Impact of the Fair Housing Act on Advertising

Section 804(c) of the federal Fair Housing Act (FHA) prohibits the making, printing, or publishing of a notice, statement, or advertisement, with respect to the sale or rental of a dwelling that indicates any preference, limitation, or discrimination based on the protected classes, or an intention to make any such preference, limitation, or discrimination.

This can apply to advertisements where the underlying property may be exempt from the Fair Housing Act provisions, but where the ad itself violates the Fair Housing Act.
